Summary/Abstract |
The ARA Libertad Case (Argentina v. Ghana) is the first instance where the International Tribunal for the Law of the Sea (ITLOS), Hamburg, Germany considered the issue of the release of a warship which was detained in a foreign port contrary to the principles of sovereign immunity of warships. The Argentinian warship was detained based on a commercial case filed by an American hedge fund against Argentina in the Ghanaian Court. According to the Court, Argentina had waived sovereign immunity in respect of the claims of the bondholders and, therefore, the warship could be arrested for execution of a monetary claim. This article examines the ITLOS order at the backdrop of warship rights and duties under the International Law of the Sea.

In August 2013, India successfully launched its latest dedicated defence satellite GSAT-7. Planned to serve as an exclusive defence satellite for the Indian Navy, the satellite, as Indian Space Research Organisation (ISRO), boasted of its safety and reliable communication. Although ISRO, which is popularly seen as a civilian space agency, could not openly accept the defence usage of this satellite, analysts claim that this satellite will serve as a force multiplier and help navy in networking all its warships, submarines and aircrafts with its ground based assets. The satellite will help the Indian Navy strengthen its blue water combat capabilities. This advanced multi-band communication satellite was launched by Ariane-5 launch vehicle of Arianespace from Kourou, French Guiana.

The sea has increased in importance as a source of useful resources. The nation that has control of its immediate and external seas is in a good position to choose how much or how little of sea resources it wants. It is the importance of the sea and the sea lines of communication to nations that has made thoughts such as maritime power, sea power, naval strategy … etc significant to them. The paper also examined the naval and constabulary relevance of the Nigerian Navy to its maritime environment. The study relied on primary and documentary data. The documentary data were sourced from books, newspapers and annual reports. The secondary sources used were subjected to textual and contextual evaluations. The primary sources was basically interviews with some important actors in the era. The paper’s study of the Nigerian Navy also identified the roles of a small navy and their importance to the maritime environment.
