Summary/Abstract |
China has made great efforts to establish a compensation system for oil pollution damage from ships. Several laws and regulations have come into effect since 2010 that have brought significant changes to the legal regime of compensation for oil pollution damage. In this article, the new legal regime for compensation for oil pollution damage from ships is examined to illustrate how China is moving closer to the international standard in this area.

Summary/Abstract |
Degradation of the marine environment pushes the law of the sea to develop both substantial and procedural measures to safeguard marine environmental sustainability. Ill-planned and non-planned activities, land, sea or sea-bed based, become one of the main forces behind marine pollution. Environmental impact assessment (EIA), as an effective precautionary tool in evaluating and monitoring potential harm of planned activities, has been rapidly and widely integrated into both national and international legal regimes. However, the rudimentary and unelaborated EIA provisions in the United Nations Convention on the Law of the Sea do not create an effective marine EIA procedure, which can be improved through a comparative study of relevant sources of international law on EIA.

Fish aggregating devices (FADs) are widely used in artisanal fisheries in the Mediterranean Sea and in tropical tuna fisheries. Thousands of FADs are lost or abandoned each year, with many causing environmental damage. This article examines whether such loss or abandonment contravenes international marine pollution law. It finds that abandonment probably constitutes “dumping” within the meaning of the international dumping regime and thus, depending on the material of which a FAD is made, is either prohibited or subject to a permit system, and that the nonaccidental loss of a FAD breaches Annex V of MARPOL. The article also considers what action may be taken against the flag states of vessels that have abandoned or lost FADs.

The seas of Northeast Asia are subject to significant risk from oil and hazardous and noxious substances spills. This article examines the issues concerning marine pollution incidents in the context of the Action Plan for the Protection, Management and Development of the Marine and Coastal Environment of the Northwest Pacific Region (NOWPAP) regime.
