Anti-dumping initiations in Indian manufacturing industries

Summary/Abstract
Anti-dumping as a new protectionist trade policy has evolved as the popular strategy choice for the trading nations. Since the Uruguay Round of World Trade Organization (WTO) (1994), India has been a prominent user of it. This article attempts to explore the possible factors that might have triggered off 90 percent cases of anti-dumping by five major Indian manufacturing industries over the period 1997–2011. We construct a balanced panel combining data on anti-dumping initiations from the ‘Global Antidumping Database’ with trade data from the Directorate General of Commercial Intelligence and Statistics (DGCI&S)-India and United Nations Comtrade database at the Indian Trade Classification (ITC) based on Harmonized System (HS) two-digit level. Having count data, the empirical model is estimated initially through a random-effects Poisson regression model followed by a negative binomial model. The number of anti-dumping initiations in India is dependent on the value of imports, the presence of a dominant industry lobby and the retaliatory behaviour by the affected domestic firms, among some others. In fact, we find that in determining the number of anti-dumping initiations the conventional economic and foreign affairs policies take a backseat!

Summary/Abstract
We explore China's behaviour in taking anti-dumping actions, with a focus on those which have been challenged under the WTO dispute settlement mechanism. We argue that the typical motivations behind China's resort to anti-dumping measures include protection, retaliation, industrial development and export promotion. These motivations are likely to carry more weight than China's observance of WTO obligations when deciding whether to impose anti-dumping measures and whether to implement WTO rulings. Brief recommendations are provided to foreign governments and exporters on how to avoid China's anti-dumping actions.

The present paper explores the opportunities for China's regional trade agreement (RTA) initiatives to mitigate its anti-dumping problems. The paper highlights the severity and discriminatory nature of China's anti-dumping problems. The high concentration of the share of anti-dumping actions taken by the top 4 and top 8 anti-dumping initiators is noted. Our finding of a weak effect of existing RTAs on mitigating China's anti-dumping problems supports the argument that China could become more active in mitigating anti-dumping problems through RTA negotiations. An RTA can include a higher level of openness in exchange for an improvement in regional anti-dumping provisions. Case studies on RTAs involving the EU, the USA and India offer some precedents for offering inducements and modifying regional anti-dumping provisions. The approaches for China may lie in obtaining market economy status from intensive anti-dumping initiators at RTA levels and also altering regional anti-dumping provisions that could be put in place in exchange for some potential concessions.
