Summary/Abstract With the increasing emergence of substandard ships sailing under the flag state's ineffective control and the growing number of accidents that negatively affect the marine environment and the maritime order, port states, coastal states, and international organizations have begun to develop new regimes to increase their control over ships. As a result, the authority of flag states is increasingly being challenged, seemingly calling into question the primary jurisdiction and control of flag states over their ships. The aim of this article is to promote a better understanding of the relationship between flag state, coastal state, and port state control.

Summary/Abstract This article discusses the Chinese legal framework in relation to ship recycling and suggests that the various legislation, standards, and opinions provide disorderly and nosystematic regulation. A uniform law specifically regulating the ship-recycling industry should be adopted by China, with a single competent authority empowered to supervise ship-recycling activities, that will effectively implement the 2009 Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships.

Summary/Abstract This paper begins with the international context concerning climate change and how China fits into this context. Concentration is then turning into the emissions control system in China including environmental planning, legislation, policy instruments and measures as well as institutional setting in China's environmental governance system. Special attentions also being paid to emissions control in China's power sector. It should be noted that the pollution discharge permit system in China only exists superficially in many places. Insufficient resources are applied to the implementation of the said permit system, which in turn means that the system is applied according to differing standards in different parts of the country. The findings of this paper suggested that emissions trading programmes are usually introduced alongside the existing policies. The power sector usually has numerous other policy objectives and therefore the design and implementation of emissions trading programmes in the sector will have to address concern about the compatibility of existing industry policies.

Summary/Abstract At present, the concept of good ocean governance is articulated in the literature only. This paper adopted eight elements of good governance as an analytical framework, namely, the rule of law, participatory, transparency, consensus-based decision making, accountability, equity and inclusiveness, responsiveness and coherence. These elements are partially supported by international treaty practice but have not yet received universal acceptance.

Summary/Abstract This paper examines international treaties in relation to the threat or use of nuclear weapons including the 1968 Nuclear Non-Proliferation Treaty and the 1996 Comprehensive Test Ban Treaty. It can be concluded that the effect of the aforesaid international treaties is still in doubt without explicit enforcement mechanisms and penalty for non-compliance. This paper also reviews the International Court of Justice's advisory opinion on the legality of the threat or use of nuclear weapons and comments that a clear explanation on the legality of use of nuclear weapons in 'extreme circumstances of self-defence' is required. Examples from current state practice in relation to nuclear non-proliferation efforts are also provided, with special attention to China, North Korea and Iran. This paper suggests that China as a leader of developing countries should extend its efforts on nuclear non-proliferation and conduct communication between North Korea and Iran and other nuclear weapons states to reduce or prohibit nuclear weapons.

Summary/Abstract With the increasing use of the oceans and coastal areas, there is a need to pay greater attention to and reexamine the issue of ocean governance. Through comparing the framework of ocean governance in mainland China with that in Taiwan in terms of legislation, administration, and law enforcement, this article establishes that there are advanced practices concerning ocean governance in Taiwan and lessons that may be applicable for mainland China.

Summary/Abstract The development of sea power theory has undergone a transformation in the contemporary context. The 21st Century Maritime Silk Road Initiative, as proposed by China, is promoted as an effort to establish a cooperative development model. This approach would also seem to be consistent with the essence of modern sea power and the 21st Century Maritime Silk Road Initiative. This article argues that in order to establish a viable legal cooperative framework, “hard power” cooperation and “soft power” cooperation models should be introduced, on the basis of current international treaties and customary law, and with reference to international experience.
