Impact of foreign direct investment on public governance and corruption in China / Lee, Ming-Hsuan; Lio, Mon-Chi   Journal Article
Lee, Ming-Hsuan Journal Article
0 Rating(s) & 0 Review(s)
Summary/Abstract The impact of foreign direct investment (FDI) on the performance of the Chinese government has recently drawn scholastic attention. Though the literature provides insightful observations on the potential influence that FDI has on the Chinese government, little empirical evidence has been provided. This article constructs a dynamic panel data set using province-level data for China from 2000 to 2009 to estimate the impact of FDI on governance performance and the level of corruption of provincial governments in China. The estimation strategy includes a dynamic panel data (DPD) model and a fixed effect (FE) model. The results suggest that foreign capital and investors improved governance performance and reduced corruption of provincial governments. Furthermore, FDI not originating from Hong Kong, Macao, and Taiwan had a greater impact on provincial governments, representing a greater shock to the Chinese governments. The findings are robust under both specifications.

Judiciary as change agent: some insights into the changing role of judiciary in India / Sharma, Rajvir   Journal Article
Sharma, Rajvir Journal Article
0 Rating(s) & 0 Review(s)
Publication 2012.
Summary/Abstract The Indian Judiciary has completed 60 years of its existence and has made long lasting contribution to the system of governance that has impacted the life of the people and the nation. In many ways, it has impacted the nature, scope and processes of public governance and can claim credit for expanding the meaning of the constitution in favor of different segments, especially the poor, of the society. It has strengthened Indian federation, catalyzed goal achievement, deepened democracy and defended people against excesses of the State. It has acted as a promoter of peace, cordiality and balance and coordination between different organs of the government. At one time it was thought that the role of judiciary is only to interpret the laws and the regulations and provide judgements exclusively from the legal point of view. This perspective has undergone a sea change in the recent times. Envisaging the role of the supreme court of India, the first Chief Justice of India, Justice Kania said: "The Supreme Court would declare and interpret the law of the land, and with the tradition of Indian judiciary, it would work in no spirit of formal or barren legalism, within the limits prescribed by the constitution. The court, as part of the federal system and as the defender of democracy, is responsive to the changes in Indian society

Limits of representative democracy / Jayal, Niraja Gopal   Journal Article
Jayal, Niraja Gopal Journal Article
0 Rating(s) & 0 Review(s)
Publication 2009.
Summary/Abstract We are conversant today with a variety of democratic deficits. There is the gap between the promise and performance of democracy; then there is also the gap between the success of procedural democracy and the failure of the project of substantive democracy. This paper reflects a different sort of democratic disappointment however. It is an interrogation, not of India's democracy per se, but of a particular strand of democratic discourse and practice in India that has become disconcertingly powerful in the last two decades. This is a line of argument that privileges representation-indeed a particular form of it-as the defining principle of democracy and in so doing, denudes the democratic ideal of all substantive content beyond representation. The microcosmic representation of all sections of the population in all institutions-not only those of public governance, but also others such as the media and the private sector-becomes the pursuit that inspires democracy, and as such every advance in this direction is seen to constitute a further deepening of democracy.

Local Governance and business associations in Wenzhou: a model for the road to civil society in China? / Jianxing Yu; Zhou, Jun   Journal Article
Jianxing Yu Journal Article
0 Rating(s) & 0 Review(s)
Publication 2013.
Summary/Abstract It is argued in our paper that current studies of civil society in China, which place too much emphasis on its 'independence', are neither practical nor conducive to the sound development of China's civil society, because an adversarial intensification is likely to arise between the state and society. As is shown in our empirical study, despite the fundamental control imposed by the government, Wenzhou Business Association is actively involved in industry governance, constantly empowered by the government, and thus gradually achieves growth and development. This leads to a conclusion that it appears to be a rather more realistic developmental path for China's civil society for associations to make full use of the government's expanding space and to actively participate in public governance.
