IN ACCORDANCE WITH the UN Charter, a Bible of contemporary international law, all UN members "shall settle their international disputes by peaceful means" and "shall refrain in their international relations from the threat or use of force" (Article 2, Paragraphs 3-4). The Charter allows, in the form of an exception to this general rule, states to use force in only two cases - as self-defense against an armed attack from the outside (Article 51) and, following a UN Security Council (UNSC) decision, to remove a threat to the peace, breach of the peace, or act of aggression (Articles 39-42).

IN NOVEMBER 2011, at the 66th Session of the UN General Assembly, Brazilian delegation presented a document "Responsibility While Protecting. Elements for the Development and Promotion of a Concept"1 implicitly suggested by the fact that NATO and its partners had misused the mandate issued by the UN SC in March 2011 as a follow-up of its Resolution 1973 on a no-fly zone over Libya to prevent the Qaddafi regime from attacking civilian targets and civilian population from the air.2

Summary/Abstract |
THE TERM "HYBRID WARFARE," the recent favorite with the media, is an ad hoc invention of American military experts and political scientists used to describe the response of Russia and the population of the Russian-speaking regions of Ukraine to the coup d'état in Kiev. It is openly stated: "Hybrid warfare - the term applied to Russia's particular approach to irregular warfare in Ukraine."1 Time has come to look into the new term's military-political and international-legal dimensions to find out who is waging "hybrid warfare" in Ukraine.
