Summary/Abstract As an archipelagic state, Indonesia is faced with a wide range of potential maritime security threats. This article analyzes the existing Indonesian legislation on baselines, archipelagic passage, and innocent passage in accordance with the 1982 United Nations Convention on the Law of the Sea. The article demonstrates the challenges that exist in implementing the key navigational rights laws.

Summary/Abstract Mediterranean European Union member states have to deal with thousands of migrants arriving by sea every year. Frontex (the EU external borders agency) organizes joint surveillance operations at sea to interdict these migrant boats, helping states to cope with the problem. This article discusses the legality of these maritime interdictions done by Frontex according to the international law of the sea as well as the conformity of the operations with the nonrefoulement principle.

Summary/Abstract With the increasing use of the oceans and coastal areas, there is a need to pay greater attention to and reexamine the issue of ocean governance. Through comparing the framework of ocean governance in mainland China with that in Taiwan in terms of legislation, administration, and law enforcement, this article establishes that there are advanced practices concerning ocean governance in Taiwan and lessons that may be applicable for mainland China.

Summary/Abstract Ocean upwelling pipes are used to upwell nutrient-rich deeper waters in order to fertilize the surface ocean. This article addresses whether international legal rules exist governing the deployment of ocean pipes and which states are entitled to exercise jurisdiction over these objects. Taking into account the need to avoid user conflicts and unauthorized deployment of upwelling pipes in marine areas under the jurisdiction of third states, the article advocates the development of nonbinding guidelines that would implement the general terms of the United Nations Convention on the Law of the Sea.
